Fighting Back Against Creditors, Debt Buyers, and Collection Law Firms

There are a number of different forms that the debt collection can take. Sometimes it’s harassing phone calls in the middle of the night, calling your employer or family to tell them about the debt, sending threatening letters, or even filing a lawsuit against you in court.

At the top of the collection totem pole are the original creditors, such as the credit card companies that issued the card originally. Next are the debt buyers, who purchase accounts from the creditors with little or no documentation at all, making it virtually impossible for them to prove that they are entitled to be paid. At the bottom are the foot soldiers for the creditors and the debt buyers — the attorneys at the debt-collection law firms — who go into court day in and day out with no proof, no documentation, and no witnesses. They count on never being challenged to prove anything that they’re claiming.

The only way to stop any of them is to fight back and make them prove it. One of the unfortunate truths about the legal system is that unless you make the person suing you prove that you owe them, they can get a judgment against you without any proof.

And if they make any mistakes, they are subject to penalties under the Fair Debt Collection Practices Act, a strict-liability statute that entitles you to as much as $1,000 for a violation of your rights.
